These terms and conditions ("Terms") govern access to and use of the garageforall.be platform (the "Service"), published by Osmonov Muratbek (the "Publisher"), personne physique established at 1457 Walhain, Belgique. The Publisher's full contact details appear in the legal notice.
The Service offers: (i) a digital vehicle passport allowing owners to centralise their vehicle's history (maintenance, documents, events), and (ii) a connection between owners and independent garages ("Partner Garages") for booking appointments and managing maintenance services.
Any use of the Service implies full and unconditional acceptance of these Terms. Users who do not accept these terms must refrain from using the Service.
As of these Terms, the Service is provided free of charge, as part of a personal project in a test phase (MVP). The Publisher does not carry out any registered commercial activity in respect of the Service and is not subject to VAT.
The Service is provided "as is", without guarantee of continuous availability, performance, or fitness for a particular purpose. The Publisher reserves the right to modify, suspend or discontinue all or part of the Service at any time, without notice or compensation, the Service being free of charge.
Any substantial change (introduction of pricing, registration of a self-employed activity, VAT liability) will be reflected in an update to these Terms and communicated to users.
The Service is an intermediation platform. The Publisher carries out no repair, vehicle maintenance, or technical service activity whatsoever. These services are performed exclusively by the Partner Garages, which act entirely independently of the Publisher.
As a result:
Creating an account requires providing accurate and up-to-date information (in particular an email address). The user is responsible for the confidentiality of their credentials and for any activity carried out from their account.
In case of suspected fraudulent use, the user must inform the Publisher without delay at support@garageforall.be.
The Publisher reserves the right to suspend or close an account in the event of a breach of these Terms, unlawful activity, or a risk to the security of the Service or other users.
The user declares that they are the owner of the vehicle for which they enter information, or that they hold a legitimate right of use or management of the vehicle (in particular a spouse, household member, employee, fleet manager, or leaseholder) allowing them to record maintenance data. Creating a vehicle passport without legitimate title over the vehicle concerned is prohibited.
The vehicle's history is kept as an append-only event log: recorded events (maintenance, documents, ownership changes) are not deleted after the fact, but may be the subject of corrective events. This mechanism is intended to preserve traceability of the history; it does not constitute a certification, nor a guarantee of authenticity in the evidentiary or eIDAS sense.
The user is solely responsible for the accuracy of the data they enter. Likewise, Partner Garages are responsible for the data they enter as part of their services (interventions, quotes, invoices, notes). The Publisher carries out no independent verification of this data and cannot be held liable for errors, omissions or false statements.
When a vehicle changes owner, the passport remains attached to the vehicle as a historical object; identity resolution is based on currently active ownership and is subject to automated checks (verified email, plate/VIN match). Upon closure of a user account, personal data is processed in accordance with the privacy policy; however, technical records attached to the vehicle (maintenance events, documents and quotes issued by Partner Garages) may be retained for traceability purposes, dissociated from the previous owner's personal data. The terms are described in the privacy policy.
Booking an appointment via the Service is a request sent to the chosen Partner Garage. Final confirmation is the responsibility of the Partner Garage and is communicated to the user (by email, SMS, or via the client area).
The cancellation, rescheduling and any penalty terms are set by each Partner Garage and are enforceable against it. The user is invited to review the chosen Garage's terms before confirming a booking.
Any quote provided by a Partner Garage binds only that Garage. The Publisher is not involved in either price-setting or invoicing between the Garage and its client.
When the Partner Garage issues a quote via the Service, the start of work is subject to prior approval of the quote by the vehicle owner. In the normal operation of the Service, the platform is designed to technically prevent a booking from moving to "in progress" status until this approval has been recorded. Any subsequent change to the quote (adding a service item, revising the price) gives rise, in the normal operation of the Service, to a new approval request to the owner before the modified items are carried out.
The Publisher takes reasonable steps to ensure the availability and security of the Service. However, given the free and experimental nature of the Service, its liability is limited to direct damages actually incurred and resulting from a proven fault on its part.
The Publisher may in particular not be held liable for:
No provision of these Terms shall limit or exclude the Publisher's liability in the event of wilful misconduct, gross negligence, or for obligations which the law prohibits from being limited.
The Publisher reserves the right to modify these Terms at any time. Users are informed of substantial changes by notification in their client area or by email. Continued use of the Service after the changes take effect constitutes acceptance.
The user may stop using the Service and request closure of their account at any time at support@garageforall.be. The processing of data after account closure (anonymisation, limited retention of technical histories) is described in the privacy policy.
These Terms are governed by Belgian law. Any dispute relating to their formation, interpretation or performance falls within the jurisdiction of the courts of the judicial district of Walloon Brabant, except for any mandatory provision applicable to consumers to the contrary.
